These products do not meet the definition of a flavored tobacco product and lack a characterizing flavor. On June 1, 2020, a Massachusetts Department of Public Health regulation took effect which required tobacco product manufacturers to certify that any tobacco products it distributes for retail sale in the Commonwealth of Massachusetts do not meet the definition of a flavored tobacco product and that the product lacks any characterizing flavor. The owner, retailer, or other person in charge of the retail establishment must maintain a record of this certification documentation and provide it upon request of any authorized enforcement agent, including Boards of Health or their agents and the Department or its agents.
