What the records show

• Preparation for the October 30, 2025 public hearing began at the Board of Health’s August 7, 2025 meeting, nearly three months in advance.
• Among the documents Amherst held while drafting was the state’s “FY 2025 Sample Regulation Restricting the Sale of Nicotine Products,” which opens with a “Checklist for Policy Decisions” presenting Nicotine-Free Generation as one selectable option among many. Amherst’s draft closely follows that template.
• The town’s files also contained the adopted tobacco regulations of Belchertown, Hopkinton and Pelham, whose language is substantially similar.
• The hearing was run from a written script that told board members not to engage while the public spoke: “Board members only need to listen to the public testimony. No BOH member will comment or ask any questions.” The script also states that at the meeting where the vote would be taken, “no further written or oral testimony will be accepted.”
• Amherst produced no email correspondence with outside advocates, though the records request specifically sought it — an absence that distinguishes this return from most others on this site.
