FDA-Authorized Products Only

This approach does not set a nicotine limit or move the product to a different store. It ties local sales to a federal decision: a retailer may sell only those products for which the Food and Drug Administration has issued a marketing order. Because the agency has authorized very few nicotine pouches and e-cigarettes, the practical reach of such a provision is wide.

No municipality whose records are published on this site has adopted the provision for nicotine pouches. Two things in these files bear on it. First, Belchertown’s Board of Health asked for a version of it: on October 3, 2024 the health district director wrote that the Board “want[s] to add into the regulations only allowing FDA approved Vape products to be sold. This was not in the updated tobacco sales draft.” The provision does not appear in the regulation Belchertown adopted. The reply in that same chain, from the Massachusetts Municipal Association’s tobacco control director, gives a reason: the federal authorization requirement “is a bit tricky to enforce since it is a federal, not state process.”

Second, Somerville’s file contains January 2026 material on the federal side: a presentation on new FDA enforcement information and a draft letter telling retailers that “only products with Marketing Granted Orders can be sold in the United States,” and that “currently, only a limited number of electronic cigarettes and an even smaller number of oral nicotine pouches have Marketing Granted Orders.” That is guidance on existing federal law rather than a local restriction.
