Ashland has not adopted a Nicotine-Free Generation regulation. What its Board of Health decided, on November 18, 2025, was that the choice was not the Board's to make: the members agreed the policy was outside their purview and asked that their position be relayed to the Town Manager.
The question did not end there. On January 7, 2026 the Board of Health met jointly with the Select Board, which took the matter under advisement and indicated it should be settled at Town Meeting by warrant article. The proposal remains live.
Ashland's file of 18 documents shows the proposal was brought to the town from outside, by physicians, a law professor and a board member from another town, using model language supplied by a university law center.
What the records show
The proposal was brought to Ashland from outside the town. Dr. Zachary Rich contacted Health Director Rajit Gupta to request a slot before the Board of Health to advocate for adoption.
Boston University law professor Katharine Silbaugh and Belchertown Board of Health member Ken Elstein appeared to testify in support. The proposed regulatory language came from the Public Health Advocacy Institute, a law center at Northeastern University.
Ashland’s file also contains meeting documentation from the Framingham Collaborative, a regional program funded by the state’s Tobacco Cessation and Prevention Program.
On November 18, 2025 the Board of Health reached consensus that the question was not its to decide. The minutes record that the members “do not feel it is the place of the Board of Health to consider and pass NFG at the Board of Health level.”
On January 7, 2026 the Board of Health held a joint meeting with the Select Board, which took the matter under advisement and indicated it should be decided at Town Meeting by warrant article.
