Pouches may be sold only in stores no one under 21 may enterThis restriction leaves the product unchanged and moves it. An adult-only retail tobacco store is a narrow category under Massachusetts law: a shop that shares space with no other business, has its own entrance, sells no food, beverages or alcohol, holds no restaurant or lottery licence, and admits no one under 21. Most towns have very few such stores, and some have none.
The practical consequence is that pouches leave the shelves of convenience stores, supermarkets and gas stations. Where a town has no adult-only tobacco store, the restriction functions as a prohibition on retail sale without being written as one — a distinction Belchertown’s health director had to explain in writing after the vote there.
This is the option most commonly adopted among the municipalities whose records appear on this site. In each case the language is close to identical, because it comes from the same model regulation.

The Board adopted the provision at the same hearing as its Nicotine-Free Generation regulation, on a motion by board member Ken Elstein, 5–0. Five days later the health director wrote to every tobacco retailer in town: the amendment “(Pg 10 section G) is the restriction of the sale of oral nicotine pouches (including but not limited to ‘Zyn’) to adult only retail tobacco stores. Therefore, all tobacco retailers in the Town of Belchertown have 60 days from 12/11/24 (February 9, 2025) to remove all unsold oral nicotine pouches from their establishment.” She also had to correct a public misreading of the vote: “the regulation that was voted on was not a language to ban, it is language to Restrict the sale of these products to adult only tobacco stores.”

Conway’s regulation states the rule in one sentence at Section G: “The sale or distribution of oral nicotine pouches is restricted to adult only retail tobacco stores.” The town’s file also contains an earlier draft, from October 2024, in which the checklist entry “9. Oral Nicotine Pouches (§G)” is the only line left unmarked while the surrounding items are marked “YES” — the provision was added between the two drafts.

The motion, made at 7:21 p.m. after 24 people testified, was “to adopt the proposed changes, including changes to the fine structure, inclusion of NFG and restriction of nicotine pouches to adult-only establishments.” It carried unanimously, effective May 1, 2025. Somerville considered a nicotine content cap alongside it and did not adopt one.

Easthampton adopted the provision at the same 2–0 vote that adopted its Nicotine-Free Generation regulation. The pouch restriction takes effect September 10, 2026 — sixteen months before the birthdate provision. The draft in the city’s file still contains both pouch options in brackets, unresolved.

Mansfield’s copy of the model regulation, dated January 6, 2025, has the adult-only option marked alongside the cap: “Prohibit more than 6 mg of nicotine per pouch YES / Sale restricted to adult only retailers YES.” What the Board adopted in August 2025 was the cap alone. The regional coordinator had told Mansfield’s health director in February that the adult-only route was still rare: “So far I think there might be only a couple of municipalities that have restricted pouches to Adult Only Stores. Orange is one.”

Milton is the one municipality here whose board removed the provision, and the document recording that step was not released. Milton’s production does not contain the January 6, 2025 minutes at which the adult-only section was struck from the draft, nor the adopted regulation text. What the production does contain is the April 28, 2025 hearing, at which the Board approved Chapters 5 and 6 unanimously — regulations that carry a nicotine content cap and no adult-only provision.
