Milton considered a Nicotine-Free Generation provision and removed it. On January 6, 2025 the Board of Health struck the birthdate language from its draft tobacco regulations, along with a separate provision that would have confined nicotine pouch sales to adult-only stores.
What Milton adopted came later and is a different thing. At a fourteen-minute public hearing on April 28, 2025 the Board approved updated tobacco regulations that include a six-milligram cap on nicotine per pouch but no birthdate provision. Milton does not appear on the Nicotine-Free Generation adoption lists published by the campaign's own organizations.
Milton's production is the smallest received from any municipality on this site — four documents, image-only scans. The records that do exist show the policy being pressed on the town before the vote and again long after it.
What the records show
Milton considered a Nicotine-Free Generation provision and removed it. On January 6, 2025 the Board of Health struck from its draft regulations the language that would have prohibited the sale of tobacco products to anyone born on or after January 1, 2004, and struck a separate provision restricting all nicotine pouch sales to adult-only stores.
What Milton adopted came later. At a public hearing on April 28, 2025 that lasted fourteen minutes, the Board voted unanimously to approve Chapter 5, “Sale of Tobacco Products to Minors,” and Chapter 6, “Smoking in Workplaces, Public Places and Membership Association,” effective June 1, 2025. Those include a six-milligram cap on nicotine per pouch and no birthdate provision.
Milton does not appear on the Nicotine-Free Generation adoption lists published by the Public Health Advocacy Institute or by Action on Smoking & Health’s Project Sunset.
The records show the policy was pressed on the town nonetheless. In June and July 2024 the Massachusetts Health Officers Association’s tobacco control program, funded by the state Department of Public Health, sent Milton’s Health Director a community assessment for the policy and an invitation to a webinar on adopting it. A campaign newsletter was still asking for an invitation to present as late as February 26, 2026.
